Default having been made of the terms of the loan documents secured by that certain mortgage executed by Annie Jones An Unmarried Woman Tony Jones An Unmarried Man Ann Jones to Irwin Mortgage Corporation dated May 22, 1998; said mortgage being recorded on June 1, 1998, in Book 1154, Page 647 in the Office of the Judge of Probate of Dallas County, Alabama. Said Mortgage was last sold, assigned and transferred to Wells Fargo Bank, National Association, not in its individual or banking capacity, but solely as Trustee on behalf of the Lake Country Mortgage Loan Trust 2006-HE1 by assignment recorded in Deed Book 1605, Page 652 in the Office of the Judge of Probate of Dallas County, Alabama.

Should a conflict arise between the property address and the legal description the legal description will control.

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above. NOTICE OF TIMBER SALE

 

DALLAS COUNTY, ALABAMA

Notice is hereby given to all interested parties that sealed per unit bids for the purchase of timber will be received until 1:00 P.M., November 5th , 2020, at the office of the Commissioner of Conservation and Natural Resources, Suite 584, Folsom Administrative Building, 64 North Union Street, Montgomery, Alabama 36130, acting by and for the State of Alabama, for the purchase and removal of timber, described herein on the following lands:

Approximately 1,070 acres of timber located in Sections 8, 9, 10, 15, 16, 17, 20, and 21, Township 14 North, Range 10 East, all in Dallas County, Alabama, on the Cedar Creek SOA.

The estimated timber volumes are 7500 tons of Eastern Red Cedar timber. Volumes are not guaranteed; bidders must satisfy themselves about volumes.

Bids will be publicly opened at 1:00 P.M., November 5th, 2020, in Suite 584, Folsom Administrative Building, 64 North Union Street, Montgomery, Alabama. This is a “pay as you cut” sale with an advanced payment of 25% of the total Estimated Sale Value due with the bid; said sum to be credited as payments due to the Department until such time as the value of timber products cut shall exceed the amount advanced. This advance payment is to be based on your per ton bid. Should the actual volume of timber cut and delivered not equal or exceed the advanced payment, the Department will refund the difference. When volumes of timber cut and delivered exceed that paid in the advance payment, further payments will be made weekly for those products harvested that week. Mailed bids should be addressed as follows: State of Alabama, Department of Conservation and Natural Resources, Division of Wildlife and Freshwater Fisheries, Wildlife Section, Attn.: Sandy Harris, 64 North Union Street Suite 584, Montgomery, Alabama 36130. All bids must be clearly marked on the front of the envelope, “WILDLIFE AND FRESHWATER FISHERIES, WILDLIFE SECTION TIMBER BID – CEDAR CREEK SOA - TO BE OPENED AT 1:00 P.M. ON November 5th, 2020”, to avoid being opened as ordinary mail.

Timber inspection may be made between 8:00 A.M. and 5:00 P.M. weekdays. Maps showing roads and locations, SMZ’s, stand boundaries, and timber contract information are available.

Timber to be sold consists of all Eastern Red Cedar timber within the harvest area. No other timber of any type is to be cut or damaged, and the sale agreement will include a heavy penalty for damage to leave trees. No skidding or logging activities will take place in or through unauthorized cutting areas or SMZ’s within the harvest area. The logger shall also keep record of these loads of timber and/or trees cut from said land and their mill of destination on site, which records will be subject to inspection during normal operating hours on the logging site. A period of twenty-four (24) months shall be allowed for timber removal. However, in the event that Conservation determines, in its sole discretion, that weather conditions have substantially impaired Contractor’s ability to complete timber harvesting operations within said period of time, Conservation may extend said period of time up to an additional period of one year. Harvested trees may be skid to the loading deck prior to being limbed and topped. Game openings and fire lanes cannot be used for loading grounds and/or skid trails. Road maintenance serving the harvest area will be the responsibility of the successful bidder. Water bars must be installed and packed on the slopes of skid trails and haul roads. Re-vegetation of skid trails and log landings will be mandatory and will be completed by the successful bidder per prescription by the Wildlife and Freshwater Fisheries Biologist. The successful bidder will be expected to work closely with the Wildlife and Freshwater Fisheries Forester for the duration of the contract. The successful bidder shall adhere to Alabama’s Best Management Practices for Forestry for the duration of this timber sale.

TERMS OF SALE: Bids will consist of a letter with your bidded rate per ton, company name, address, and contact information. Your bid will consist of one rate per ton, which will apply to all Eastern Red Cedar timber harvested from the sale area. The bid must be accompanied with a 25% deposit in the form of a cashier’s check or a certified check based on the Estimated Sale Value coinciding with your bid rate. The deposit of the successful bidder will be applied toward the advance payment. Payments will be made payable to: “Alabama Department of Conservation and Natural Resources”.

The contract shall contain all standard clauses and provisions used by the Department of Conservation and Natural Resources, Division of Wildlife and Freshwater Fisheries, Wildlife Section, in contracts of this type. Successful bidder should execute and return the contract to the Department of Conservation and Natural Resources, Division of Wildlife and Freshwater Fisheries, Wildlife Section, together with the required performance bond (said bond will be valid for 90 days post contract to assure timber operations meet specifications, and shall be in the amount of $25,000 in the form of a performance bond, irrevocable letter of credit, or certified check, as approved by the Department) within ten days of the date of receipt of contract; otherwise, the award may be deemed to have been withdrawn.
